Terms of Use
This is an English translation provided for convenience. The French version available at /cgu is the legally binding version. In the event of any discrepancy between the French and English versions, the French version shall prevail.
Purpose
These Terms of Use ("Terms") govern access to and use of the website monmeilleurdemenageur.fr (the "Website") by any visitor or registered user ("User"). The Website is published by Mon Meilleur Déménageur, a French company registered under SIREN 891 840 704. Use of the Website constitutes full and unreserved acceptance of these Terms.
Acceptance of terms
By accessing the Website, you acknowledge that you have read, understood and accepted these Terms without reservation. If you do not accept all or part of these Terms, you must refrain from using the Website.
For paid services or services involving matchmaking with a Partner, additional contractual documents apply in conjunction with these Terms, namely the Terms of Sale applicable to consumer clients and the Partner Terms of Use applicable to professional Partners.
User account
Access to the Website is free of charge for visitors. Certain features require the creation of a user account through the dedicated registration pages.
The User undertakes to provide accurate, complete and up-to-date information when creating an account. The User is solely responsible for the confidentiality of the credentials used to access their account. Any action carried out via the User's account is presumed to have been performed by the User.
Mon Meilleur Déménageur reserves the right to suspend or delete any account in the event of a breach of these Terms, proven fraud, abusive behaviour or any conduct prejudicial to the platform.
Services provided
The Website offers, in particular, the following services:
- Publication of editorial, informational and SEO content relating to moving services in France;
- A quote request workflow allowing Users to describe their move and receive matched offers from verified Partners;
- A messaging and document exchange area between Users and Partners;
- An account area allowing Users to track the status of their requests and contracts.
Mon Meilleur Déménageur uses reasonable endeavours to keep the Website available 24/7 but cannot guarantee uninterrupted availability.
User obligations
The User undertakes to:
- Use the Website in accordance with all applicable laws and regulations;
- Refrain from submitting fraudulent or fictitious quote requests;
- Refrain from any attempt to circumvent the technical and security measures of the Website;
- Refrain from reproducing, extracting or redistributing all or part of the Website's content without prior written authorisation;
- Refrain from soliciting Partners outside the official matching system implemented by Mon Meilleur Déménageur;
- Treat other users and Partners respectfully in any communication routed through the Website's messaging area.
Editor's responsibility
Mon Meilleur Déménageur acts as a technical intermediary between Users and Partners. The moving services themselves are provided under the sole responsibility of the Partner selected by the User. To the maximum extent permitted by French law, Mon Meilleur Déménageur shall not be held liable for the performance of services provided by Partners, the content of quotes issued by Partners, or any contractual breach occurring between a User and a Partner.
Mon Meilleur Déménageur verifies its Partners at onboarding (SIRET, Kbis, RC pro insurance, road transport licence, URSSAF compliance) but does not guarantee the quality of any individual service delivery. A mediation service is offered in the event of a dispute.
Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under French law.
Intellectual property
The Website, including its structure, design, graphic charter, texts, illustrations, photographs, logos, source code, databases and trademarks (including the "Mon Meilleur Déménageur" trademark registered with INPI), is the exclusive property of Mon Meilleur Déménageur or of its licensors. Any reproduction, representation, adaptation or extraction without prior written authorisation constitutes an infringement punishable under Articles L. 335-2 and following of the French Intellectual Property Code.
Personal data
The processing of personal data carried out through the Website is described in detail in the Privacy Policy.
Modification of terms
Mon Meilleur Déménageur reserves the right to amend these Terms at any time. The version applicable to any given use is the version published on the Website at the date of that use.
Governing law and jurisdiction
These Terms are governed by French law. The User who qualifies as a consumer within the meaning of the French Consumer Code may bring proceedings before the court of the User's domicile in accordance with Article R. 631-3 of the French Consumer Code. In all other cases, the courts of Nanterre (Hauts-de-Seine, France) shall have exclusive jurisdiction.
